Justice Blackmun

A number of journalists, including some I usually like, seem to be reacting against what they perceive as an excess of attention to the recently released personal papers of Justice Blackmun. I've even heard it suggested that this is a non-event that's being inflated by the liberal media to "suck the oxygen out of the room" during Bush's campaign launch. That last is pretty silly, considering that a) the media didn't exactly choose the day that would be five years after Blackmun's death, and b) Bush had already lost control of the coverage of his campaign kickoff by controversially using 9/11 images in his campaign ads.

Stories about Blackmun's friendship with Burger seem to be particularly popular targets. Frankly, I don't get what they're upset about. I think it's fascinating and edifying to get details of how the high court works. I found the Blackmun/Burger story quite moving. The story on how Roe v Wade was nearly overturned in '92 may perhaps shock some people into turning out to vote this fall -- we said in '00 that control of the court was at stake, and it's still true today.
